Opposition political party CHADEMA files petition to nullify mayoral election

Great opposition political party (CHADEMA) filed yesterday a petition before the Kisutu Resident Magistrate’s Court challenging the results of Kinondoni mayoral election that gave victory to CCM candidate. Chadema boycotted the mayoral election held at Kinondoni municipality on Sunday last week claiming that it was conducted without a quorum. 

The quorum of 2/3 of all members was supposed to be between 23 and 35 persons but only 18 members were present and voted.
The petition was submitted by Chadema advocate John Mallya on behalf of Mustafa Muro who was nominated by Chadema as the candidate for Kinondoni municipal and Jumanne Bunju who was supposed to be his deputy.


The respondents in the petition are Msasani councilor Benjamin Sitta (CCM) who was announced new mayor and his deputy Manyama Mangaru.
Others were Kinondoni municipal director Aaron Kagurumjuli who was the chairperson of the election process and municipal’s administration officer.


Speaking outside the court advocate Mallya said that on their petition, they are challenging the results including the winners because the election was conducted one sided.
They request the court to give the declaration that mayoral and deputy mayoral election conducted on 23 October, this year was null and void.


The petitioners further requested the court to order the Kinondoni municipal to conduct fresh election within the framework of free and fair election.
“A permanent injunction to restrain Kinondoni director and his administration officer from violating municipal by-laws about election of mayors and deputy is within the jurisdiction of this court,” the petition said.


On Sunday, Sitta Msasani Ward councillor through Chama Cha Mapinduzi (CCM) was elected new Kinondoni Mayor while Manyama, also from CCM, had been elected deputy Mayor in the polls after the opposition boycotted the election.

The opposition boycotted the election, demanding that Education, Science, Technology and Vocational Training Minister Professor Joyce Ndalichako should not have been allowed to take part in the election and that their two disqualified members should have been allowed to participate in the election.

It all started after Prof Ndalichako was sworn in as councillor and later participated in the election while Salma Mwassa and Susan Lyimo from the opposition were denied taking part on ground that they were no longer Kinondoni residents.
The elections were held after Kinondoni District was divided into two districts namely Kinondoni and Ubungo.
